Founding Partner at Warner & Fitzmartin Attorneys

Elissa Fitzmartin is a South Florida personal injury attorney and founding partner of Warner & Fitzmartin, based in Lake Worth, Florida. For more than a decade, she has stood between injury victims and the powerful insurance companies that underestimate them — making sure every client gets a fair fight.

Her path to personal injury law didn’t start in a classroom. It started on an icy road in Connecticut on New Year’s Eve, when she was 18 and home from college for winter break. She caused a serious accident on roads she couldn’t control — and spent years convinced the ice made it impossible to avoid. It wasn’t until she became a plaintiff’s attorney that she finally understood something that changed how she sees every case she takes: drivers have a duty to drive safely, and sometimes that means choosing not to drive at all. That shift — from defendant to advocate — is at the core of everything she does.

She earned her B.A. from the University of Maryland and her J.D. Magna Cum Laude from the University of Miami School of Law in 2012, the same year she was admitted to The Florida Bar. She began her career in criminal defense, where she developed sharp courtroom instincts and a deep belief in holding powerful institutions accountable. A few years in, she made a deliberate choice to move exclusively into personal injury — where she could give every client access to the same quality of legal fight, regardless of what they could afford.

“When a client comes to me scared and overwhelmed, I take the time to explain the entire process — because a lot of times, this is the first time they’ve ever been involved in an accident. I explain step by step what we’re doing, what they need to do, and how we’re staying on top of their medical care the whole way through. Everyone making an injury claim has one thing in common — they’re injured. But it’s how your injuries have affected your specific life that makes you different than the person down the street. Your hobbies, your family, your work. There’s no way to fight for you unless the lawyer truly gets to know you as a person.”

She Doesn’t Stop When It Gets Hard

For Elissa, a win isn’t always the largest number on a check. When a hit and run driver fled the scene, she spent five months tracking him down — and when she found him, his insurance company paid immediately. When there’s no insurance at all, she pushes at-fault drivers to be personally responsible, because telling a client there’s nothing she can do isn’t something she’s willing to accept. When a settlement offer is too low, she doesn’t take it. When the facts support going to trial, that’s where she goes.

When a client’s case crosses state lines, she follows it — co-counseling with out-of-state attorneys when needed so her Florida clients never have to navigate that alone.

She is admitted to practice before the U.S. District Court for the Southern District of Florida and has been admitted Pro Hac Vice in South Dakota Federal Court — so when a case needs to go federal, she’s ready.
